FDA REGULATIONS ON CBD

IS CBD LEGAL

Hemp-derived CBD is federally legal in the United States under the 2018 Farm Bill, which removed hemp from the list of controlled substances and reclassified it as an agricultural commodity. Hemp is legally defined as cannabis containing no more than 0.3% THC (the intoxicating compound in marijuana) on a dry-weight basis. Because CBD itself is non-intoxicating and does not produce a “high,” hemp-derived CBD products that meet this THC threshold are federally lawful.
